Pre- and Post-Trial:  Planning for the Before and After

NHACDL will hold its Spring CLE on Friday, May 16, 2014 at The Derryfield Country Club, 625 Mammoth Road, Manchester, NH. Registration will begin at 8 am and the CLE start promptly at 8:30 am.  The CLE will include 6 Hours of CLE Credit with 1 hour of ethics.

Topics and Speakers Include:

David Harris, University of Pittsburgh School of Law, discussing the premise behind his recent book, Failed Evidence: Why Law Enforcement Resists Science.  Professor Harris will explores the real reasons that police and prosecutors resist scientific change and how defense lawyers can impact this failure to provide justice. 

John Durkin, Burns, Bryant, Cox, Rockefeller & Durkin,  will present ethical issues in the Attorney/Client relationship, case intake challenges and initial case preparation.

Donna Brown and Emma Sisti, NH Public Defender, will cover strategies and preparation for major litigation.  Big cases require a different treatment than your average misdemeanor or low-level felony.  This segment will cover systems for large amounts of discovery, when to use PC hearings, getting depositions and other strategies for large case management. 

Jeffrey Kellett, NH Department of Safety, Division of State Police, explains the current system of annulment in New Hampshire and how your client's criminal records will be handled once it comes into existence.

Chris Johnson, NH Public Defender, takes a look at the direction in which the US and NH Supreme Courts are headed; i.e. which provisions are "live" under each constitution in terms of moving in a direction that may or may not help the criminal defendant.

Phil Utter, Green & Utter, will discuss post conviction challenges - an overview on screening them, preparing them, and the basics of habe deadlines, exhaustion requirements, state court before federal court, the Strickland standards, and what types of attorney errors are most likely (and least likely) to lead to good outcomes.

This CLE is open to defense practitioners only.
